Frequently Committed Offences

  1. Illegal Entry
    Section 6(3) Immigration Act 1959/63

    A foreigner whose presence in Malaysia can be interpreted as illegal entry if :

    1. Fails to produce a genuine passport/travel document/entry permit upon request.
    2. Passport/travel document does not have a valid endorsement/pass

    b. The penalty for an offence on illegal entry:

    1. A fine not exceeding RM10,000 or to imprisonment for a term not exceeding 5 years or both and shall also liable to whipping of not more than six strokes.
    2. A compound of RM3,000.00

    c. As such foreign visitors are reminded :-

    1. To take precaution on the safety of their passport/travel document and must carry with them during their stay in Malaysia.
    2. Must ascertain that they produced their passport/travel document to an Immigration officer at the point of entry and has been issued with the relevant pass.
    3. To report immediately to the Immigration Department for the lost of their passport/travel document.

  2. Overstaying

    Section 15(4) Immigration Act 1959/63

    a. Stay exceeding the expiry date/cancellation of visit pass.

    b. The penalty for an offence on overstaying :-

    1. A fine not exceeding RM10,000 or to imprisonment for a term not exceeding 5 years or both
    2. A compound of RM3,000.00
    3. As such foreign visitors are reminded to leave Malaysia before their pass expired.

  3. Make, Falsify Or Amend A Document Or Endorsement

    Penalties
    A. Section 55D of the Immigration Act 1959/63 (Act 155)

    1. A fine of not less than RM30, 000 and imprisonment of not less than 5 years but not more than 10 years and shall also be liable to whipping of not more than 6 strokes.

    2. Any person who makes any false documents:

    i. intends to avail itself or by any person;
    ii. used by itself or by any other person;

    as a passport for the purposes of this Act (Passports Act 1966 Act 150) is a violation of section 12B of the Passports Act 1966 (Act 150).

    A fine of not less than RM15, 000 but not more than RM100, 000 and imprisonment of not less than 2 years but not more than 10 years and with whipping of not more than 6 strokes of rattan
